It was quieter than usual that Tuesday morning as Jamie Ross readied herself for work. Katie was visiting Neil’s mother, and Neil was in his study getting together files to take to the office. She had been eating breakfast, while going over a deposition, when she heard her husband’s familiar footsteps. Quick and pressing. He commanded attention in the way that he walked, but she was used to it, and her eyes stayed on the papers at hand, piece of buttered toast up to her mouth.

He walked into the kitchen, just like he did every morning before he left for work. Today, however, instead of throwing down the morning newspaper, he tossed a manila envelope in front of her. She looked up. Before she could speak, he did.

“I’m putting you on notice, Jamie. I’ve filed for divorce.” There was no hint of emotion on his face. He had thrown down a gauntlet in the form of a manila envelope.

“Wh-what?” She dropped her half-eaten piece of toast back on her plate.

“You heard me. I won’t say it again. The marriage counselor was a quack…and this marriage…” He looked straight at her, not flinching. “This marriage is over.”

She managed to not choke on the piece of bread that she had been chewing.

“Neil, you can’t just-”
“I’m not going to argue with you about this, Jamie. All we ever do is argue. I have to get to work. I’ve a meeting in an hour…” He looked pointedly at his watch.
“You can’t just say it’s over like you say ‘how’s the weather?’ Neil.”
“I’m taking up residence in the country house. And I’ve filed for sole custody of Katie.”
“What? Why??”
“It’s not like you’re ever home to be her mother…”
“That’s rich coming from you!”
“I can provide for her better. With the pittance you make at the DA’s office, you’ll barely get by.”
Her eyes narrowed. He still couldn’t handle that she’d left his firm to work in a public servant’s position.

“You’re a brilliant legal mind,” he’d told her. “And you’re going to waste it working for McCoy and his cronies?”

She stared right back at him. Now that she’d had a chance to regroup, her game face was on.

“I’m sure I’ll be able to get by just fine on whatever alimony you’re going to be dishing out, Neil.” Her eyes were hard. “Don’t think you can just waltz out of this marriage singing a happy tune.” Her smirk was dark. “Aren’t you glad you didn’t sign a pre-nup? I know I am. I wonder how that will look to a divorce court judge…struggling single mother working on a DA’s office salary…and the bastard who owns part of a law firm who leaves her without batting an eye.”

His jaw was clenched as he met her gaze. She’d called him out and he could think of nothing more to say. And so he did the cowardly thing and turned on his heel.

“I’ll see you in court,” he called out, back to her, heading for the door.

She took a few deep breaths before realizing that Katie was at Neil’s mom’s… He couldn’t just take her like that…

“I’m her father, she’s my daughter. I can take her wherever I want,” Neil said plainly, after she’d chased him to his waiting car.

“And what about my rights?” She glared at him.

“I’m not going to abduct her or something ridiculous, Jamie. How stupid do you think I am?” He got halfway in his car. “I’ll have my lawyer call yours about custody arrangements during the time before the trial.”

“Do it today.” She crossed her arms. “Or I’ll get a warrant.”
He laughed out loud. “Jack McCoy doesn’t scare me, and neither does Adam Schiff. You get a warrant and I’ll have it thrown out.”

She continued to glare.

He got into the car, calling out, “I’ll have them do it this afternoon.”
